Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Catch mobile application ("App"), the website https://choosecatch.com ("Site"), and related tools and services (collectively, the "Services") provided by Kikoff Inc. ("Kikoff," "we," "us," or "our").
By accessing or using the Services, you ("you", "your" or "User") agree to be bound by these Terms and our Privacy Policy https://choosecatch.com/privacy, which is incorporated by reference. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Services.
1. Agreement to Terms
By downloading, installing, accessing, or using the Services (including by connecting financial accounts, viewing potential claims, or initiating any claim filing), you:
- Acknowledge that you have read, understood, and agree to be bound by these Terms;
- Agree to the collection, use, and disclosure of your information as described in our Privacy Policy; and
- Represent that you have the authority to enter into these Terms personally or on behalf of any entity you represent.
If you do not agree to any of the above terms, stop using the Services immediately and uninstall the App.
IMPORTANT: THESE TERMS INCLUDE AN ARBITRATION AGREEMENT REQUIRING INDIVIDUAL ARBITRATION OF MOST DISPUTES AND A WAIVER OF CLASS ACTIONS AND JURY TRIALS. PLEASE REVIEW CAREFULLY.
2. Eligibility Requirements
You may use the Services only if:
- You are at least 18 years of age (or the age of majority in your jurisdiction, if higher);
- You have the legal capacity to enter into a binding contract;
- You are located in a jurisdiction in which the Services are lawfully available and not subject to any applicable sanctions, export controls, or other legal restrictions; and
- You are not prohibited from using the Services under applicable law.
If you use the Services on behalf of a company or other legal entity:
- You represent and warrant that you are authorized to bind that entity to these Terms; and
- "You" and "User" will also refer to that entity.
We may limit or restrict access to the Services (or any part thereof) for any User, geographic region, or jurisdiction at any time, in its sole discretion.
3. Limited License & Use Restrictions
3.1 Limited License
Subject to your continued compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Download and install one copy of the App on a mobile device you own or control; and
- Access and use the Services solely for your personal, non-commercial use in discovering class action or similar claims that may be relevant to you and optionally initiating claims.
All rights not expressly granted to you are reserved by us and its licensors.
3.2 Use Restrictions
You agree that you will not:
- Copy, reproduce, modify, adapt, translate, publicly display, distribute, or create derivative works of the Services, except as expressly permitted in these Terms;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services, except to the extent permitted by applicable law;
- Rent, lease, sell, sublicense, assign, or otherwise transfer the Services or any rights in them;
- Access or use the Services for competitive analysis or to build a competing product or service;
- Use any robot, scraper, crawler, spider, or other automated means to access or interact with the Services, except as expressly authorized by us;
- Bypass or circumvent any access controls or security measures of the Services; or
- Use the Services for any illegal, fraudulent, or unauthorized purpose, including submitting or assisting in the submission of false, misleading, or fraudulent claims.
4. Account Responsibilities
4.1 Registration & Account Security
To use certain features of the Services, including automatic claim matching via connected financial institutions and the "auto-file" functionality, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration and keep it updated;
- Maintain the confidentiality of your login credentials;
- Not share your account or credentials with any other person; and
- Immediately notify us of any suspected unauthorized access or use of your account.
You are solely responsible for all activities that occur under your account, whether or not authorized by you.
4.2 Financial Account Connections (Plaid and Similar Providers)
To discover potential claims automatically based on your transactions, we may offer the option to connect your bank, card, or other financial accounts using a third-party provider, such as Plaid Inc. ("Plaid") or similar services.
By choosing to connect a financial account:
- You authorize us and our third-party providers to access, view, and use information from your connected accounts (such as transaction data) solely for purposes of providing and improving the Services, including identifying potential eligible claims and populating claim forms;
- You acknowledge that such connections and data access are governed by the terms and privacy policies of those third-party providers (e.g., Plaid's terms and privacy policy), in addition to these Terms; and
- You represent that you are authorized to grant such access for the accounts you connect.
You may disconnect your financial accounts at any time through the app, but previously accessed data and any claims already initiated or filed may continue to be used as described in these Terms and the Privacy Policy.
4.3 Auto-File and Authorization to Act on Your Instructions
For certain claims, we may offer an auto-file feature that allows us to pre-fill, submit, or assist with the submission of claim forms on your behalf based on your information and instructions.
By enabling auto-file and proceeding through the authorization flow (including electronic signature, button press, or other affirmative actions), you:
- Authorize us to use your information, including transaction data and personal details you provide, to complete forms and submit claim information to third-party claim administrators, litigation sites, law firms, or other relevant parties, acting solely as your agent for data entry and submission;
- Represent and warrant that all information you provide (and that we submit on your behalf) is true, accurate, and complete to the best of your knowledge;
- Acknowledge that we do not represent you as your attorney and does not exercise legal judgment on your eligibility, claim strategy, or legal rights; and
- Agree that you remain solely responsible for reviewing all claim details, confirming accuracy, eligibility, and validating the information in any claim before submission.
You may revoke your authorization for future submissions at any time by disabling auto-file within the app; such revocation will not affect claims already submitted.
5. No Legal Representation or Guarantee of Results
We are not a law firm and do not provide legal, tax, or financial advice. The Services are for informational and administrative purposes only and are designed to help you discover potential claims and facilitate your interaction with third-party claim administrators, law firms, or other entities.
Accordingly:
- No information or content provided through the Services, including claim descriptions, estimated payout ranges (e.g., "up to $X"), deadlines, or eligibility indicators (e.g., "possibly eligible"), constitutes legal advice or a legal opinion.
- No attorney-client relationship is created between you and us or any of its employees, contractors, or representatives.
- We do not and cannot guarantee that:
- You are eligible for any particular claim;
- You will receive any recovery or payment;
- Any claim will be approved, timely processed, or paid; or
- The amount you may receive will match any estimate or range shown in the Services.
You are encouraged to consult with a licensed attorney in your jurisdiction if you require legal advice about your rights or any specific claim.
6. User Conduct Restrictions
You agree not to use the Services to:
- Violate any applicable law, regulation, court order, or third-party rights;
- Submit, assist in submitting, or encourage others to submit false, exaggerated, or fraudulent claims;
- Impersonate any person or entity or misrepresent your affiliation with a person or entity;
- Claim to be an authorized representative for others without proper authority;
- Upload or transmit any viruses, malware, or other harmful code;
- Interfere with or disrupt the integrity or performance of the Services or related systems;
- Attempt to gain unauthorized access to any accounts, systems, or networks; or
- Harass, threaten, or otherwise harm other users or Kikoff personnel.
We reserve the right—but have no obligation—to investigate, suspend, or terminate accounts and to cooperate with claim administrators, law enforcement, and other authorities in connection with suspected fraudulent or unlawful activity.
7. Intellectual Property Rights
The Services, including all software, user interfaces, text, graphics, logos, icons, images, designs, data, and other content (collectively, the "Catch Content") are owned by us or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Except as expressly permitted by these Terms:
- You do not acquire any ownership interest in the Services or Catch Content;
- You may not use our names, logos, trademarks, or trade dress without our prior written consent; and
- Any rights not expressly granted herein are reserved.
If you choose to submit ideas, suggestions, or feedback about the Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid, sublicensable license to use, modify, and exploit such Feedback without restriction or compensation to you.
8. Third-Party Services & Links
The Services may display or link to third-party websites, offers, products, services, claim administrators, litigation portals, law firms, settlement websites, or financial data providers (collectively, "Third-Party Services").
For example, the App may:
- Redirect you to an external settlement or law firm website to complete a claim;
- Use a provider such as Plaid to facilitate secure connection to your financial accounts; or
- Present offers or informational content from third parties.
You acknowledge and agree that:
- Third-Party Services are not controlled, owned, or operated by us;
- We do not endorse and are not responsible or liable for any Third-Party Services, their content, accuracy, or practices;
- Your use of Third-Party Services is entirely at your own risk and is subject to the third party's own terms and privacy policies; and
- Any relationship, dispute, or transaction between you and a third party (including a law firm, claim administrator, or financial institution) is solely between you and that third party.
9. Additional Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
We expressly disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability.
No advice or information, whether oral or written, obtained from us or through the Site or App, shall create any warranty not expressly stated herein.
We are not responsible for any interruptions, delays, errors, data loss, or security breaches. You assume all risk for use of the Site, App, and any linked third-party sites.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIKOFF AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR USE), ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, APP, CONTENT, OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE, APP, OR CONTENT IS TO STOP USING THEM.
11. Termination
11.1 By You
You may stop using the Services at any time and may request deletion of your account as described in the App or our Privacy Policy. Deleting the App alone does not necessarily delete your account or data.
11.2 By Us
We may, in its sole discretion and without liability to you, suspend or terminate your access to all or part of the Services at any time, including if:
- You violate these Terms or any applicable law;
- We suspect fraudulent, abusive, or harmful activity;
- Providing the Services is no longer commercially or technically feasible; or
- We discontinue the Services generally.
Upon termination:
- The rights and licenses granted to you will immediately cease;
- You must stop using the Services and delete all copies of the app; and
- Certain provisions that by their nature should survive (including Sections 5-13 and any accrued rights) will continue in effect.
Termination will not affect any claims already submitted through the Services; your relationship with claim administrators or law firms will be governed by their separate terms.
12. Governing Law
These Terms and any dispute arising out of or relating to them or the Services will be governed by and construed in accordance with the laws of the State of California, U.S.A., without regard to its conflict-of-laws principles, except where otherwise required by applicable law.
13. Dispute Resolution by Binding Arbitration; Jury Trial & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.
Most customer concerns can be resolved quickly and informally by contacting hello@choosecatch.com. If a dispute cannot be resolved informally, you and Kikoff agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms, the Site, App, or services ("Claim") exclusively by binding, individual arbitration administered by the American Arbitration Association ("AAA") under its applicable rules.
- No Class Actions: Claims must be brought on an individual basis only; you and Kikoff waive any right to participate in a class, collective, or representative action.
- No Jury Trial: By agreeing to arbitration, you waive the right to a jury trial.
- Small Claims Exception: Either party may bring a claim in small claims court if eligible.
- Location & Fees: Arbitration will be held in a mutually convenient location or virtually. The parties will be responsible for their own legal fees and costs, unless otherwise required by law.
- Opt-Out: You may opt out of this arbitration provision within 30 days of first agreeing to these Terms by sending written notice to: Kikoff Inc., 633 Folsom St., Suite 300, San Francisco, California, 94107.
14. Changes to Terms
We may update or modify these Terms from time to time. When we do, we will revise the "Last updated" date above and, where required by law or where we deem appropriate, provide additional notice (such as in-app notification, email, or a banner).
Unless otherwise specified, changes will be effective when posted. Your continued access to or use of the Services after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Services and uninstall the app.
